This Testing Network is provided on an “as-is” and “as-available” basis, and Latticex Foundation Limited and its affiliates expressly disclaim any and all warranties and conditions of any kind, whether express, implied or statutory. Latticex Foundation Limited and its affiliates make no warranties in respect of safety, stability, due maintenance, accessibility, value, storage of data and certain functions, among others, of this Testing Network or any Testing Token. The limited functions of the Testing Token refer to the relevant functions under testing and adjustment in this Testing Network within a short period of time, and thus, the Testing Tokens do not correspond to any stable function in the long term, and do not have any function or economic basis of usual transfers or trading of tokens or cryptocurrencies.
Warranties by You
You represent and warrant to LatticeX Foundation Limited and its affiliates at all times that:
(a) You have reviewed and fully understand the contents of the Whitepaper and Bluepaper (available on the PlatON website) in their entirety, including, without limitation, the features, functionalities, characteristics and operations of, and the risks associated with, the PlatON Main Network and the LAT tokens as described therein (on which the Testing Network and Testing Token are based), and you have reviewed and fully understand all other information that is necessary or advisable to have been reviewed before making an informed decision to utilise the Testing Network and the Testing Tokens;
(b) You have a sophisticated and deep understanding of the features, functionalities, characteristics, usage, storage, transmission mechanisms, operations and other intricacies associated with cryptographic tokens, like Bitcoin (BTC), Ether (ETH), other cryptographic tokens based, for instance, on the Ethereum ERC-20, the LAT token and the Testing Token;
(c) You understand that the utilisation of the Testing Network and Testing Tokens involve various risks (including those set out in the "Disclaimer" section of the Whitepaper), and you fully understand such risks;
(d) You acknowledge and accept that:
(i) LatticeX Foundation Limited is not licensed or approved by the Monetary Authority of Singapore ("MAS"), and there is currently no intention for LatticeX Foundation Limited to apply for any financial services licence or regulatory approval under the laws and regulations of Singapore. The Testing Token does not constitute, and is not characterised as, a financial instrument regulated by MAS. Therefore, you will not be able to invoke or avail yourself of any regulatory protection by MAS;
(ii) the value of the Testing Token may fluctuate greatly;
(iii) you will not be able to receive any form of profit, income, or other payments or financial returns arising from the acquisition, holding, management, utilisation or disposal of the Testing Token;
(iv) LatticeX Foundation Limited is not holding any fiat money and/or Testing Tokens or other digital assets as your trustee, and is not acting as your broker, intermediary, agent, trustee, advisor or in any fiduciary capacity; and
(v) no communication or information provided to you by LatticeX Foundation Limited and its affiliates shall be considered or construed as any form of advice.
Limitation of Liability
You are responsible for any loss or damage, whether direct, indirect, incidental, consequential or of any other nature, arising out of or relating to logging into this Testing Network, or obtaining, using and/or transferring any Testing Tokens, and to the maximum extent permissible under applicable laws, Latticex Foundation Limited and its affiliates are not responsible for any such loss or damage. This disclaimer of liability applies to any damages, whether based on alleged breach of contract, tortious behavior, negligence or any other cause of action, including but not limited to damages or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, and/or theft, destruction or unauthorized access to, alteration of, or use of any record.
Exceptions
Nothing in this disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this disclaimer will exclude or limit Latticex Foundation Limited and its affiliates’ liability in respect of any: (a) death or personal injury caused by the negligence of Latticex Foundation Limited and its affiliates; (b) fraud or fraudulent misrepresentation on the part of Latticex Foundation Limited and its affiliates; or (c) matter which it would be illegal or unlawful for Latticex Foundation Limited and its affiliates to exclude or limit, or to attempt or purport to exclude or limit, its liability.
Reasonableness
By logging in this Testing Network, you agree that the exclusions and limitations of liability set out in this disclaimer are reasonable.
Unenforceable Provisions
If any provision of this disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this disclaimer.
If you do not agree with any content of this disclaimer, please log out and stop using this Testing Network immediately, and stop receiving, using and transferring any Testing Token immediately. If you do not log out this Testing Network or stop receiving, using or transferring the Testing Token, such act(s) of not logging out, receiving, using and/or transferring any Testing Token will be deemed as your agreement with the entire content of this disclaimer.
